Engagement
By engaging Massive Marketing, you agree to collaborate with us for the agreed scope of work outlined in any proposals, agreements, or project briefs. Both parties commit to working together to fulfil the project requirements in a timely and professional manner.
Termination
Either party may terminate the engagement by providing written notice. A reasonable notice period, as agreed upon in the project terms, must be provided. If termination occurs without the agreed notice period, a cancellation fee may be applicable.
Massive Marketing reserves the right to cease services in cases of non-payment or breach of these terms.
Cancellation Fee
If a project or service is terminated without the required notice, a cancellation fee may apply. This fee will be calculated as a percentage of the outstanding balance or monthly fee, as agreed in the project terms.
Payments
- Payments for services are due on a regular basis, as agreed in the project terms.
- Payments must be made promptly via bank transfer or any other method outlined in the invoice.
- Late or missed payments may result in work being paused or terminated until payments are up to date.
Any changes to fees or payment structures will be communicated in advance and formalised in writing before implementation.
Data Sharing & Protection
Both parties agree to comply with applicable data protection laws, including but not limited to the Data Protection Act 2018 and GDPR.
- Any data shared by the client must be necessary for the fulfilment of the project.
- Massive Marketing agrees to safeguard this data and not disclose it to third parties without prior consent, except as required by law.
Commitments & Deliverables
Massive Marketing commits to delivering high-quality work within agreed timeframes and project scope. However, we will not be held liable for delays or incomplete deliverables resulting from:
- Third-party interference.
- Delays caused by the client, including but not limited to missing information or approvals.
The client agrees to provide all necessary access, tools, and information required to complete the project. Failure to do so may result in delays or the inability to complete the work.
Exclusivity
Engagement with Massive Marketing does not constitute an exclusive arrangement. We reserve the right to work with other clients, provided all contractual obligations to you are met in a timely manner.
Intellectual Property
Upon full payment, ownership of final deliverables will transfer to the client. Massive Marketing retains the right to showcase completed work in its portfolio, marketing materials, and case studies unless otherwise agreed in writing.
Limitation of Liability
Massive Marketing shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services. Our maximum liability shall be limited to the total fees paid by the client for the specific project.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes will be resolved under UK jurisdiction.
Amendments to Terms
Massive Marketing reserves the right to update or amend these terms and conditions at any time. Changes will be effective immediately upon being posted on our website. Continued use of our services constitutes acceptance of the updated terms.
